Missouri Calls Novig Gambling. Novig Filed a Federal Lawsuit.

The state gave Sweeney's prediction market firm until October 17 to get a gambling license or stop ... Novig's response: a federal judge in St. Louis and the argument that Missouri has no jurisdiction at all.

Missouri gave Novig a deadline. Novig filed a federal lawsuit the day before it hit.

On October 16, Novig sued Missouri Attorney General Catherine Hanaway in U.S. District Court in St. Louis, asking a federal judge to block Missouri from treating its prediction market contracts as sports betting. The state had given Novig until October 17 to obtain a state gaming license, pay a 10% wagering tax, or shut down operations in Missouri.

Novig's legal argument is clean: the Commodity Futures Trading Commission designated the company a federal "contract market" in June 2026. Under the Commodity Exchange Act, that federal designation gives the CFTC exclusive jurisdiction. State gambling law, in Novig's reading, simply does not apply.

Missouri's position is equally direct. An AG spokesperson told the Spokesman-Review: "In both situations, it's sports betting, and Missourians voted to subject sports betting to licensing and taxation rules." The state has a real stake in this fight: Missourians have wagered roughly $2 billion since sports betting launched there on December 1, 2025, generating $11.77 million in tax revenue through July 2026.

Novig Has Done This Before

Missouri is not Novig's first state fight. The company has filed federal preemption suits against New York, Massachusetts, Washington, New Mexico, and Wisconsin since August, each time making the same CFTC argument. Courts have responded unevenly: the Third Circuit sided with Kalshi (a prediction market competitor) over state authority, while the Sixth Circuit ruled that states can regulate sports prediction contracts. The Eighth Circuit, which covers Missouri, is currently weighing the same question in an Iowa case, with briefing planned for later this year. That ruling could settle the Missouri dispute before any judge gets to the merits here.

The pattern matters. Novig is not waiting for states to enforce their orders and then absorbing the consequences. It is going on federal offense, seeking a ruling that makes all future state cease-and-desist letters legally moot. It is the same instinct the company showed in its advertising: instead of backing down from the backlash over its Sydney Sweeney campaign, it posted another ad.

Where Sweeney Sits

Sydney Sweeney took an undisclosed equity stake in Novig and a creative director title approximately in September 2026, per Fortune's reporting. She has not commented publicly on the Missouri lawsuit. Neither has Novig beyond the court filing itself. The creative director is, for the moment, letting the complaint do the talking.

If the Missouri lawsuit sticks, it joins a growing docket of federal cases that could, collectively, establish prediction markets as a federally regulated category outside state gambling law. If it loses, Missouri becomes one more state where Novig has to either comply or exit. Novig has not indicated it plans to exit any state where it has sued.
