Polymarket Is Catching Election Fraudsters. Washington Left It Alone.

Polymarket's former FBI investigator has investigated dozens of midterm betting cases and referred two to the CFTC. Today those bets settle. The regulator has done almost nothing.

Today is Election Day for the 2026 midterms. More than $836 million in contracts on Congressional control sit on Kalshi and Polymarket, ready to settle as returns come in tonight. Inside Polymarket's offices, Shana Bautista is watching.

Bautista is a former FBI official and cryptocurrency analyst who joined Polymarket in June 2026 as its head of global intelligence and investigations. She told NPR in late October that her team of 16 and a new election surveillance system are actively policing the platform ahead of today. Some days the system fires hundreds of alerts at her phone. The system pulls in gigabytes of data per user: social media, FEC filings, cryptocurrency company records, banking partners, statistical models, public sources. When a user hits a threshold of internal red flags, Bautista gets the notification.

If you have information that you have a duty to protect, don't trade on it. It's explicitly against our terms of use on both platforms, but also is against the law. If you decide that you are smarter and can do it, we will find you.
Shana Bautista, head of global intelligence and investigations, Polymarket, to NPR, October 2026

The threats she is watching for have already produced cases. In May, NPR reported that campaign staffers had made thousands of dollars on Polymarket using insider polling information to bet on their own candidates. Kalshi, for its part, banned and fined a handful of political candidates in April after they were caught betting on themselves. In May, Kalshi said it had blocked dozens of campaign staffers from trading on elections. At least one staffer told NPR they found a way around that block.

Two Cases Made It to the CFTC

At least two of Polymarket's election investigations have been referred to the Commodity Futures Trading Commission, according to a person familiar with the matter who was not authorized to speak publicly, per NPR's October 27 report. The CFTC, the industry's federal regulator, "has done little" to police these platforms and has largely left enforcement to the companies themselves. An NPR investigation published October 8 found the agency has been weakening its oversight of the prediction market sector.

Bautista said the surveillance work mirrors what has existed in traditional financial markets for decades. She described a hypothetical manipulation pattern: someone opening several different accounts in short bursts with consistent device IDs across new wallets. Findings from past cases feed back into the detection models.

There's never been a case that we work where we haven't been able to identify, potentially, who these people are.
Shana Bautista, Polymarket, to NPR

The Expert Warning No One in Congress Has Acted On

Rajiv Sethi, an economics professor at Barnard College at Columbia University, told NPR that election prediction markets are uniquely vulnerable to market manipulation and insider trading. His concern goes beyond individual fraud. Election markets carry a risk that standard financial markets do not: what traders believe will happen can shape what actually happens, if a candidate is perceived to be losing momentum and the campaign begins to believe it too.

Elections have the property that what one believes is going to happen can actually affect what happens if a candidate is thought to be losing momentum or the campaign is flagging.
Rajiv Sethi, economics professor, Barnard College at Columbia University, to NPR

What Settling Looks Like Tonight

Markets settle as states certify results over the coming days. Users of Kalshi and Polymarket had already placed more than $197 million in bets on midterm results as of June, per an NBC News analysis. The total trading volume across all midterm contracts reached $836 million on Kalshi's hub by October 6, according to data cited by MEAWW and covered in our earlier report on Kalshi's Wisconsin miss. That article also raised the accuracy question: whether these platforms predict correctly. Today adds the integrity question: whether they stayed clean.

These platforms advertised the wisdom of crowds as their product. The more pressing question settling tonight is whether the crowds were playing fair, and whether the one team watching has the legal backing to do anything about it when they were not.
